This terms of service agreement sets forth the terms and conditions which apply to the use by you of the JobSnake web site (Product). The right to use the Product is personal to you and is not transferable to any other person or entity. Your use of this web site signifies your acceptance to these terms and conditions.

Definitions

1. The Product is JobSnake, a web site directory accessible on the Internet at www.jobsnake.com containing hyperlinks and advertising banners to third party web sites.

2. Visitors are individuals who access any page at JobSnake web site using a browser, script, spider, robot, program or any other means.

General

JobSnake shall have the right at any time to change or discontinue any aspect or feature of the Product including, but not limited to, content, hours of availability, and equipment / software needed for access or use.

2. THE PRODUCT IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

THE DISCLAIMERS OF LIABILITY CONTAINED IN THIS SECTION APPLY TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.

4. IN NO EVENT WILL JOBSNAKE OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THE PRODUCT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT OR OUT OF THE BREACH OF ANY WARRANTY.

5. UNDER NO CIRCUMSTANCES WILL JOBSNAKE BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A VISITORS RELIANCE ON INFORMATION OBTAINED THROUGH THE PRODUCT. IT IS THE RESPONSIBILITY OF EACH VISITOR TO EVALUATE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION, AVAILABLE THROUGH THE PRODUCT.

6. EACH VISITOR SPECIFICALLY ACKNOWLEDGES THAT IN NO EVENT WILL JOBSNAKE, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ACCESS TO THE PRODUCT.

Indemnification

Each Visitor agrees to defend, indemnify and hold harmless JobSnake, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of the Product.

Trademarks

All JobSnake logos are trademarks of JobSnake. All other names and logos appearing on JobSnake are trademarks or registered trademarks and the property of their respective owners.

Equipment

Each Visitor shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed to access Product. Visitors shall be responsible for all charges related thereto.

Miscellaneous

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
